Immigration Law FAQs
What are the requirements for obtaining a UAE residency visa?
To obtain a UAE residency visa, you must meet specific criteria depending on the type of visa you are applying for, such as employment, family sponsorship, or investment. Generally, the process involves securing a sponsor (such as an employer or family member), passing a medical examination, obtaining health insurance, and submitting the necessary documentation, including your passport, a passport-sized photo, and proof of accommodation. The visa is typically processed through the General Directorate of Residency and Foreigners Affairs (GDRFA).
What happens if a UAE resident stays outside the country for more than six months?
If a UAE resident stays outside the country for more than 180 days continuously, their residency visa may be automatically canceled. However, certain exemptions apply, such as for Golden Visa holders, students studying abroad, or residents who are outside the country for medical treatment or on a work assignment. In such cases, it may be possible to retain the residency visa by applying for an entry permit before re-entering the UAE.
What are the penalties for overstaying a visa in the UAE?
Overstaying a visa in the UAE can result in fines and other penalties. Typically, the fine is AED 50 per day for overstaying on a residency visa. For visit or tourist visas, the fines are also AED 50 per day. If the overstay continues, the individual may be subject to further legal actions, including potential deportation.
