Employment Law FAQs

To obtain a work permit in the UAE, an employer must submit an application to the Ministry of Human Resources and Emiratisation (MOHRE) along with the necessary documents, such as a valid passport copy, a recent photograph of the employee, a job offer letter, and an attested educational certificate. The application must also include a medical fitness certificate for the employee. Work permits are typically issued for a limited period and must be renewed before expiration.

Under UAE Labor Law, the probation period for new employees cannot exceed six months. During this period, either the employer or the employee can terminate the employment contract with a notice period of at least 14 days. After the completion of the probation period, the employee cannot be placed on probation again by the same employer. If the employee continues to work after the probation period, it is considered a confirmation of employment, and the terms of the employment contract become fully enforceable.
