What is the process for registering a trademark in the UAE?
To register a trademark in the UAE, you must file an application with the UAE Ministry of Economy. The application should include details of the trademark, such as its design or logo, the goods or services it will represent, and the applicant’s information. After submission, the Ministry will examine the application to ensure the trademark is distinctive and not identical or similar to existing trademarks. If approved, the trademark will be published in the official gazette, allowing for any objections. If no objections are raised, the trademark will be registered, and the owner will be granted exclusive rights to use and enforce it.
How are patent rights protected and enforced in the UAE?
Patents in the UAE are protected under Federal Law No. 11 of 2021 on the Regulation and Protection of Industrial Property Rights. A patent grants the inventor exclusive rights to use, make, and sell the invention for a period of 20 years. To obtain a patent, the invention must be novel, involve an inventive step, and be industrially applicable.
